1. Acceptance of Terms
By accessing or using the services provided by Nucax ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Nucax provides digital services including but not limited to:
- Web Development: Custom website and web application development
- UI/UX Design: User interface and experience design services
- Mobile Development: iOS and Android application development
- AI Integration: Artificial intelligence solutions and integrations
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information required for the project
- Respond to communications in a timely manner
- Provide necessary assets, content, and feedback as requested
- Ensure you have the rights to any materials you provide
- Make payments according to the agreed schedule
4. Intellectual Property
Upon full payment:
- You will own the final deliverables created specifically for your project
- We retain the right to use generic, reusable code and components
- We may showcase the work in our portfolio unless otherwise agreed
- Pre-existing materials and third-party assets remain property of their respective owners
5. Payment Terms
- Payment terms will be outlined in individual project agreements
- A deposit may be required before work begins
- Late payments may result in project delays or suspension
- All prices are subject to applicable taxes
6. Project Timeline
Project timelines are estimates and may vary based on project scope, client feedback, and revision requests. We will communicate any significant changes to the timeline. Delays caused by client response times may extend the project deadline.
7. Revisions
The number of revisions included will be specified in the project agreement. Additional revisions beyond the agreed scope may incur extra charges. Major changes to project scope or direction may require a new agreement.
8. Limitation of Liability
To the maximum extent permitted by law, Nucax shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you for the specific service in question.
9. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This includes but is not limited to business strategies, technical specifications, and financial information.
10. Termination
Either party may terminate the agreement with written notice. Upon termination, you will be responsible for payment for all work completed up to the termination date. Any deposits may be non-refundable depending on work already performed.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
12. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective when posted on this page. Continued use of our services after changes constitutes acceptance of the modified terms.
